This Privacy Policy (“Policy”) describes the privacy practices of CustomHub LLC (“CustomHub”) and its corporate affiliates, meaning companies related by common ownership or control to CustomHub, responsible for collecting and maintaining certain information collected about you. We never share the information of our Customer’s customers under any circumstances, unless it is required to complete the transaction contracted with our Customer. In addition, we require our Customers, where applicable, to undertake to respect all relevant data protection laws, including the European Union General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act of 2018 (“CCPA”) and the state and federal law of the United States. This Policy applies to all personal data collected, processed, and stored by CustomHub in relation to its staff, suppliers, and service recipients in the course of its activities, as defined in GDPR and CCPA, and other relevant laws. CustomHub makes no distinction between the rights of EU Data Subjects who are employees, and those who are not. All are treated equally under this policy.

This Policy applies to our sites, products, and services (collectively, “Services”) that link to this Policy. CustomHub is a controller of all Personal Information subject to this Policy for our direct-to-consumer Services. While CustomHub currently does not offer an API, we are committed to providing our users with high-quality services and may consider developing an API in the future to enhance the functionality of our platform. In the event that an API is made available, the following guidelines will apply:

  • Users will be required to obtain appropriate authentication credentials, such as an API key, to access the CustomHub API.
  • Access to the API may be limited based on user account type, subscription level, or other criteria determined by CustomHub.

5. Commercial Use

While CustomHub currently does not offer an API, we understand the importance of clear guidelines for commercial use in the event that an API becomes available. The following are hypothetical restrictions and permissions that would apply to the commercial use of the CustomHub API:

Permitted Commercial Uses:

  • Integration with Business Applications: Businesses may integrate the CustomHub API with their own applications to streamline operations, such as inventory management, order processing, or customer relationship management.
  • Development of Complementary Services: Developers may create and offer services or features that complement and enhance the functionality of CustomHub, such as custom reporting tools or analytics platforms.

Prohibited Commercial Uses:

  • CustomHub reserves all rights to its trademarks, logos, and other branding elements. Any unauthorized use may constitute trademark infringement and could lead to legal action.

7. Indemnification and Release of CustomHub

Users of CustomHub’s services and API (when available) agree to indemnify, defend, and hold harmless CustomHub, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these terms of use, your use of the CustomHub platform, including, but not limited to, your User Content, any use of CustomHub’s intellectual property, services, and products other than as expressly authorized in these terms of use or your use of any information obtained from CustomHub.

a) Scope of Indemnification:

  • This indemnification covers any claim or demand made by any third party due to or arising out of your access to CustomHub, use of CustomHub’s services, your breach of these terms, or your infringement of any intellectual property or other rights of any person or entity.

b) Indemnification Process:

  • In the event of a claim, CustomHub will provide you with written notice of such claim, suit, or action. CustomHub reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with CustomHub in asserting any available defenses.

c) Release:

  • By using CustomHub, you release CustomHub, its affiliates, and their respective officers, directors, employees, and agents from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with disputes between users, or between users and any third party.

d) Limitation of Liability:

  • In no event will CustomHub, its affiliates, or their licensors, service providers, or agents be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, CustomHub’s services.

    e) Survival:

    • The indemnification and release provisions outlined in this section shall survive the termination or expiration of your use of CustomHub’s services and API.
